Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement, have the legal capacity to enter into these Terms, and will comply with all applicable laws.

2. Your Account

To use the Service, you must create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, complete, and current information when registering. Notify us immediately at support@gynka.app if you suspect unauthorized access to your account.

3. Free Trial and Subscription

3.1 Free Trial

Gynka offers a 7-day free trial. A valid payment method is required to start your trial. You will not be charged during the trial period. If you do not cancel before the end of the trial, your subscription will begin automatically and your payment method will be charged.

3.2 Subscription Fees and Billing

Subscriptions are billed on a recurring monthly basis at the price displayed at the time of purchase. Prices are subject to change with advance notice. Users subscribed at a given price before a price change continue at their locked-in rate for as long as their subscription remains active and uninterrupted. All payments are processed through mobile platform billing systems (Apple In-App Purchase, Google Play Billing) and our subscription management provider.

3.3 Automatic Renewal

Your subscription automatically renews at the end of each billing cycle unless you cancel at least 24 hours before the end of the current period. You can cancel at any time through your Apple ID settings, Google Play account, or within the app.

3.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period and you will retain access until then. Except where required by applicable law, all fees are non-refundable. Refund requests for purchases made through Apple or Google must be directed to the respective platform.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service, reverse engineer it, or attempt to extract its source code.

5. User Content and Data

The Service allows you to submit information such as profile data, training logs, readiness check-ins, messages with the AI coach, and data from connected wearable devices (collectively, "User Content"). You retain ownership of your User Content. By submitting User Content, you grant Gynka a worldwide, royalty-free license to host, store, reproduce, process, analyze, and display your User Content solely for the purpose of operating and improving the Service, as further described in our Privacy Policy.

6. Wearable and Third-Party Integrations

The Service may allow you to connect third-party devices and platforms such as Oura, WHOOP, Garmin, Fitbit, Apple Health, and others. Your use of any third-party device or platform is governed by that third party's terms and privacy policy. Gynka is not responsible for the accuracy, availability, or performance of any third-party device, platform, or data feed.

7. AI-Generated Content

Gynka uses artificial intelligence to generate training programs, coaching messages, readiness scores, and other output ("AI Output"). AI Output is provided for informational and personal training purposes only. AI Output may contain errors or recommendations that are not suitable for your specific circumstances. You are responsible for evaluating AI Output before acting on it. Your use of any AI Output is at your own risk.

8. Health Disclaimer — Not Medical Advice

GYNKA IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The Service is provided for general fitness and informational purposes only. It is not a substitute for professional medical advice. Always consult a qualified healthcare professional before beginning any new exercise program, especially if you have any medical condition, injury, or concern. You acknowledge that you engage in physical training at your own risk.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Violate or infringe the rights of others, including intellectual property and privacy rights.
• Upload or transmit any malicious code, viruses, or harmful content.
• Attempt to interfere with or gain unauthorized access to the Service.
• Use any automated means — bots, scrapers, crawlers — to access or collect data.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Resell, sublicense, or make the Service available to third parties as a commercial product.
• Impersonate any person or misrepresent your affiliation with any entity.

10. Intellectual Property

The Service, including all software, design, text, graphics, logos, and trademarks, is owned by Gynka or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to use Gynka's trademarks, logos, or branding without our prior written permission.

11. Feedback

If you send us feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation.

12. Third-Party Services

The Service may integrate with third-party websites, applications, or services not operated by Gynka. We are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are solely between you and the third party.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time and for any reason, including if you breach these Terms. Upon termination, your right to use the Service ends immediately.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, Gynka disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYNKA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

Gynka's total aggregate liability for all claims will not exceed the greater of (a) the total amount you have paid to Gynka in the twelve months preceding the event giving rise to the claim, or (b) USD $100.

16. Indemnification

You agree to indemnify and hold harmless Gynka and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any applicable law.

17. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Delaware.

20. Apple App Store Additional Terms

If you downloaded the Gynka app from the Apple App Store, you acknowledge that these Terms are between you and Gynka only, not with Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

21. Google Play Additional Terms

If you downloaded the Gynka app from Google Play, you acknowledge that these Terms are between you and Gynka only. Google is not responsible for the Service or its content. Your use of the Service must also comply with the Google Play Terms of Service.

22. General

• Entire agreement: these Terms and our Privacy Policy constitute the entire agreement between you and Gynka concerning the Service.
• Severability: if any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver: our failure to enforce any right or provision will not be considered a waiver.
• Assignment: you may not assign these Terms without our prior written consent.
• Notices: notices to Gynka must be sent to legal@gynka.app.
